Terms of Use

1. Welcome

These Terms of Use ("Terms") are a binding agreement between you and Jetson 1101 LLC ("OMW," "we," "us"), and they govern your access to and use of the OMW mobile application, the website at imonmyway.app, and any related web pages or services (together, the "Service").

By creating an account, by tapping "I agree" during sign-up, or by using the Service in any other way, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Who can use OMW

You must be at least 13 years old to use OMW. If you are under the age of majority in your state or country, a parent or legal guardian must agree to these Terms on your behalf and supervise your use of the Service. By using OMW you represent that you meet the age requirement and have legal capacity to enter into these Terms.

OMW is intended for adults to coordinate transportation for themselves and the people they care for, including their children.

3. Your account

When you create an account, you agree to provide accurate information and to keep it current. You are responsible for everything that happens on your account. Keep your phone number and any sign-in code private — if someone else has access to your phone, they can sign in as you.

Notify us at support@imonmyway.app if you suspect unauthorized access.

You may delete your account at any time from Profile → Privacy & Safety → Delete account.

4. What OMW does — and what it doesn't do

OMW is a coordination tool. It lets a driver share a live location and ETA with a small set of recipients of the driver's choosing, for the duration of a single trip or as part of a recurring route.

OMW is not:

• A ride-hailing or for-hire transportation service. OMW does not dispatch drivers, set fares, or collect payment for rides.
• A safety service. We do not monitor your trips, intervene if something goes wrong, or guarantee anyone's safety. Drivers are responsible for safe driving; passengers and parents are responsible for safe pickups.
• An emergency service. In an emergency, call 911 (or your local emergency number).
• A guaranteed delivery system for SMS or push notifications. Carrier networks, push providers, and recipients' devices may delay or fail to deliver messages. Do not rely on OMW for time-critical notifications where a missed message could cause harm.

5. Your responsibilities when you use OMW

You agree that you will:

• Use OMW only for lawful, personal coordination purposes.
• Drive safely. Do not interact with the OMW app while operating a vehicle. Use a phone mount and hands-free controls, and obey all traffic laws in your jurisdiction.
• Only share trips with people you have permission to share with.
• Keep child profile information accurate and only add children you are the parent or legal guardian of.
• Not use OMW to stalk, harass, surveil, threaten, or coerce another person.
• Not use OMW to share a real-time location of a person without their knowledge and consent (this includes vehicle owners and passengers).
• Not attempt to reverse engineer, decompile, or interfere with the Service.
• Not use OMW in connection with any illegal activity.

We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms.

6. SMS messaging (A2P 10DLC notice)

OMW sends three types of SMS — sign-in verification codes, carpool trip notifications, and route invitations — to the mobile phone number you entered when you created your OMW account.

How you opt in. You consent to receive these SMS by entering your own mobile phone number during account signup. The signup screen displays the following disclosure directly above the verification button:

Tapping Send Verification Code is the opt-in action.

• Sign-in verification codes: a 6-digit code when you sign in to OMW on a new device.
• Carpool trip notifications: when a driver in a carpool you are a member of starts a trip — "driver is on the way," ETA updates ("5 / 10 / 20 min away"), "arrived at stop," and trip-completion confirmations.
• Route invitations: when another OMW user adds you to a recurring carpool, a notification with a link to view the route in the app.

• Message frequency: varies — zero in a quiet month, several per trip when your carpools are active.
• Carriers and cost: standard message and data rates from your mobile carrier may apply. OMW does not charge for SMS; your carrier may.
• Opt-out: reply STOP to any OMW SMS at any time. You will receive one confirmation that you have been opted out, and we will not send further SMS. Reply START to opt back in. Opting out of SMS does not affect your account or push notifications.
• Help: reply HELP to any OMW SMS for support info, or email support@imonmyway.app.
• Carrier disclaimer: carriers are not liable for delayed or undelivered messages.

We do not share, sell, or transfer your mobile phone number or your SMS opt-in status to any third party for marketing. The only third party involved in SMS delivery is Twilio, our SMS provider.

7. Location services

OMW collects location only while you have started a trip as the driver. Sharing stops automatically when the trip ends, you cancel it, or arrival is detected. You can stop sharing at any time by tapping "Cancel trip."

When you grant background-location permission, you allow OMW to continue updating your live ETA after you put the app in the background — necessary so the people you share with see your progress without you keeping the app open while driving. You can revoke this permission at any time in your device settings; doing so will limit OMW's ability to deliver accurate live ETAs while the app is backgrounded.

8. User content

You retain ownership of the content you put into OMW (your name, routes, child profile information, messages, etc.). By using the Service you grant us a non-exclusive license to process that content solely as needed to operate the Service for you and your recipients.

You are responsible for the content you create in OMW, including in-trip and route chat messages. We are not responsible for content created by other users.

9. Third-party services

OMW relies on third-party services (described in our Privacy Policy, Section 5.3) to operate. We are not responsible for those services' uptime, accuracy, or behavior beyond our reasonable control.

Some jurisdictions don't allow the exclusion of certain warranties or the limitation of certain damages — in those jurisdictions, the exclusions above apply only to the extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless Jetson 1101 LLC and its officers, directors, employees, and agents from any claim, demand, damage, or expense (including reasonable attorney's fees) arising out of your use of the Service or your violation of these Terms.

13. Termination

You may stop using OMW and delete your account at any time. We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law.

Sections that by their nature should survive termination (including Sections 10, 11, 12, 14, 15) will survive.

14. Governing law and disputes

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws principles. The exclusive venue for any disputes arising out of or related to these Terms or the Service is the state or federal courts located in Monmouth County, New Jersey, and you consent to personal jurisdiction in those courts.

To the extent your jurisdiction provides you with mandatory consumer-protection rights, nothing in this section limits those rights.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you in-app or by email at least 14 days before they take effect. By continuing to use OMW after the changes take effect, you accept the updated Terms.

16. Miscellaneous

These Terms (together with the Privacy Policy) are the entire agreement between you and Jetson 1101 LLC regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later.

You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of substantially all of our assets.
